Buyers
Sellers (Owners) in Arizona do not have to be Licensed Professionals in Real Estate to sell their home, nor do Buyers have to be Licensed Professionals in order to buy their own home in Arizona.
If, however, one person is representing another person in the exchange of Real Property, that person must be a Licensed Real Estate Professional in the State of Arizona.
Arizona State Law requires fair and impartial representation in the exchange of Real Property. If a Buyer buys a home from an Owner who is represented by a Real Estate Professional; that Real Estate Professional must represent the Buyer also - without financial compensation from the Buyer.
While it is legal for one Real Estate Professional to represent both the Buyer and the Seller, a conflict of interest can develop. Therefore, it is best for the Buyer to have representation also - known as a Buyer's Agent or Buyer's Broker. While the Buyer's Agent or Buyer's Broker works for the Buyer, their fees are paid by the Seller's Agent and the Buyer has an agent representing them on the Purchase exclusively.
Sellers

AGC Realty Services has two Primary Programs available to Sellers.
Program A - 2% Listing Agreement
- This Listing Agreement allows AGC Realty Services to Represent the home for sale at 2% of the Sales Price.
- The home is marketed on the Internet and through other Direct Marketing efforts to sell the home.
- An AGC Realty Services Sign is placed in the yard.
- Potential Buyers are Pre-Qualified and appointments are set to show the home.
- Average Sales time for this type of Listing is, currently, 40 days.
Program B - 4% Listing Agreement
- This Listing Agreement allows AGC Realty Services to Represent the home for sale at 4% of the Sales Price.
- The home is marketed on the Internet and through other Direct Marketing efforts to sell the home.
- An AGC Realty Services Sign is placed in the yard.
- The home is listed with the Arizona Multiple Listing Service and available for view to 16,000 Real Estate Agents and the general public.
- 3% of the 4% Listing is offered to Buyer's Agent for helping to sell the home with the remaining 1% going to AGC Realty Services.
- Buyers are represented by another Real Estate Professional, but are still Pre-Qualified and appointments to view have been set.
- Average Sales time for this type of Listing is, currently, 5 days.
Programs A and B above are offered to everyone. However, there are an infinite number of possibilities for developing a Special Program for the Seller. An example of this could be a Flat Fee Listing for the sale and/or exchange of Real Property.

Exchanging Real Property in Arizona
For example purposes the following information will utilize a home with a Sales Price of $100,000.00 and Loan Balance of $78,000.00. Read it from both the Buyer's and Seller's points of view.
The Listing Broker (Seller's Agent) signed a 4% Listing (3% to Buyer's Agent and 1% for Seller's Agent). Buyer's Agent brings a buyer to the table. The buyer makes an offer and it goes back and forth, a little, before agreed to at $98,000. The Seller and Buyer have certain duties to perform immediately (open escrow, disclosures, due diligence, get moving on the purchase - TIME IS OF THE ESSENCE, etc.).
The Buyer has 10 days to get an inspection completed and to report to the Seller what the Buyer likes and does not like about the Inspection. The Seller has 5 days to respond to the Buyer about the Inspection and whether or not the items will be fixed. If all is ok, both parties move forward. Its these 10 to 15 days that are key to canceling the Purchase Contract with the return of Escrow Funds - all other items can make the Purchase Contract VOIDABLE, but NOT VOID.
Of Note: "SOLD AS IS, OWNER WILL MAKE NO REPAIRS" or "RENTAL HOME, NO SPDS AVAILABLE" are not allowed in the State of Arizona. These two situations come up all the time because NOT MANY KNOW ABOUT THE CHANGES IN THE LAW.
Inspection is completed and both Parties agree on the Inspection Items. Closing approaches in the 30 days following the acceptance of the Purchase Agreement. The Title Company determines the need for $100,500.00 (Sales Price + Closing Costs). Buyer plans on a $9,800.00 Down Payment and a loan(s) for $88,700.00. Title Company informs Seller of $1,000.00 in needed closing costs (fronted to Seller, not needed in cash at Closing).
Title Company takes the $100,500.00. Title Company pays off ($78,000) the Old Lender. Title Company pays Broker Fees in the amount of $3,290.00 ($822.50 to Seller's Agent and 2,467.50 to Buyer's Agent). Title Company takes $1,000.00 from the balance (to cover Seller's Closing costs). Title company gives Seller a check for $18,210.00 (proceeds from the Sale) and Buyer gets Warrantee Deed for the Home with the new Lender in 1st position on the lien.
